Citation

1        These regulations may be cited as the Order Criteria and Factors Regulations.


Definitions

2        In these regulations,

 

“Act” means the Halifax Regional Municipality Charter;

 

“order” means an order that the Minister may issue under Section 223B of the Act to extend or alter an urban service area;

 

“urban service area” means an urban service area as defined in Section 223B of the Act.


Criteria and factors for issuing orders

3        (1)    Before issuing an order, the Minister must consider whether the extension or alteration of the urban service area is related to any of the following:

 

                   (a)      materially increasing housing supply;

 

                   (b)     supporting major employment growth;

 

                   (c)      removing barriers to significant economic development opportunities;

 

                   (d)     advancing provincial population growth objectives.

 

          (2)    The Minister must not issue an order unless it is proposed by 1 of the following:

 

                   (a)      the Municipality;

 

                   (b)     a department of the provincial government;

 

                   (c)      a Crown agency;

 

                   (d)     another provincial authority.

 

          (3)    In the order, the Minister must state that extending or altering the urban service area does not include a requirement that the Municipality service the area or require or guarantee infrastructure servicing in the area.
