Changes to traffic safety legislation

The Traffic Safety Act (TSA) passed in the Nova Scotia Legislature in October 2025 and will come into effect on 19 October 2026. The Act will modernize the rules of the road and improve safety for Nova Scotians on roads and highways across the province. The Act will replace the Motor Vehicle Act (MVA), in place since the early 1900s. The Traffic Safety Act has greater flexibility, enabling government to respond more quickly to modern and evolving transportation needs.

This page contains information related to the Traffic Safety Act that is not currently in effect. This information is provided to help Nova Scotians prepare for the Traffic Safety Act, expected to take effect on 19 October 2026. Continue to follow the Motor Vehicle Act until then.

Upcoming changes that will impact agriculture

Farm business and FM plates

What is being changed

The Motor Vehicle Act (MVA) uses the definition of farmer, which is income based and dependent on the individual. The Traffic Safety Act (TSA) does not define farmer but refers to the definition of farm business. The TSA references the Farm Registration Act for the definition of farm business.

Heavy farm tractor trailer process

What is being changed

Drivers who operate heavy farm tractors with trailers currently require a Class 3 driver’s licence. Under the TSA, drivers can be issued an endorsed Class 5 driver’s licence. This will reduce red tape, lower costs and eliminate the need for a medical report.

There will be no change to the current testing process.

Action required

If you currently hold a restricted class 3 driver’s licence (condition 23), you may apply to downgrade your licence to an endorsed class 5 driver’s licence. You may do this at any time or upon renewal of your driver’s licence.

Updated definitions

What is being changed

Farm implement – a vehicle that meets all of the following criteria:

  • it is capable of being towed
  • it is manufactured, designed, redesigned, converted or reconstructed exclusively for use in operating a farm business

Farm machine – a motor vehicle that is manufactured, designed, redesigned, converted or reconstructed for use in operating a farm business, and includes a combine, seeder, and sprayer.

Farm tractor – a motor vehicle that meets all of the following criteria:

  • it is wheeled or tracked
  • it has at least 2 axles
  • it has a minimum design speed of at least 6 km/h
  • its main function lies in its tractive power
  • it is specially designed with a power take-off to pull, push, carry and actuate interchangeable equipment designed to perform agricultural work

Heavy trailer – one of the following vehicles:

  • a trailer with a gross vehicle weight of greater than 4500 kg
  • a farm implement with a gross vehicle weight of greater than 4500 kg

Light trailer – one of the following vehicles:

  • a trailer with a gross vehicle weight of 4500 kg or less
  • a farm implement with a gross vehicle weight of 4500 kg or less

Trailer – a vehicle that is designed to carry or accommodate persons, property or equipment and to be towed behind another vehicle, but does not include either of the following:

  • a farm implement
  • a side car attached to a motorcycle
