Nova Scotia’s Incompetent Persons Act is still in effect until December 28, 2017, after a ruling by the Supreme Court of Nova Scotia. In its June 13th decision, the Court granted the Province's request for an extension of the validity of the legislation. This request was made as a result of the general election being called on April 30th.
Government has developed replacement legislation and anticipates passing a new act in the fall session.
The Incompetent Persons Act and current guardianship orders remain valid and in place until replacement legislation is passed.
