Releases of Crown Interest in Certain Unacknowledged Ungranted Lands
Under Part 2 of the Land Titles Clarification Act
The Department of Natural Resources is working to clear up outstanding claims associated with unacknowledged ungranted lands in the province. When the Province issues a Certificate of Release, it affirms that the Province of Nova Scotia asserts no interest or claim in the land identified in the Certificate. The Crown retains any rights that are described under the ‘saving and reserving’ portion of the Certificate. The Certificates are registered at the Land Registry for the County in which the land is located.
The Certificate acts to release the Crown's interest in the lands but does not transfer the ownership of the lands to any particular individual or company. The information in the Certificate shows the areas of ungranted land that have been released, but is not intended to replace the exercise of professional judgment by lawyers or surveyors with respect to title, location, boundaries, or extent issues related to a specific parcel. On February 12, 2014 the Department of Natural Resources recorded a county-wide release of its interest in unacknowledged ungranted Crown land in Hants County.
